A. THE CUSTOMER HERE BY AGREES TO PURCHASE AND MAYFAIR (UK) LTD (HERE IN AFTER CALLED THE COMPANY) AGREES TO SELL THE GOODS AS SPECIFIED AND AT THE PRICE AGREED AT THE TIME OF SALE

B. THIS CONTRACT IS ACCEPTED ONLY ON THE BASIS WHERE DELIVERY AND INSTALLATION TIMES ARE GIVEN IN GOOD FAITH, CONDITIONAL UPON BEING ABLE TO SUPPLY THE NECESSARY GOODS FROM THE SUPPLIERS WHICH IS OUTSIDE THE COMPANY'S CONTROL, ALSO FAILURE TO SUPPLY DUE TO DELAYS CAUSED BY THE STRIKE OR ACCIDENTS OR ACTS OF GOD.

C. SUPPLIED ONLY GOODS ARE SOLD ON THE UNDERSTANDING THAT THE CUSTOMER IS FULLY AWARE AND ACCEPTS COMPLETE RESPONSIBILITY THAT THE GOODS SUITS THE REQUIREMENTS REGARDING SPECIFICATION AND INSTALLATION IN ALL CIRCUMSTANCES.

D. THE COMPANY CAN NOT ACCEPT LIABILITY FOR DAMAGE TO GOODS, IF THE CUSTOMER HAS PREVIOUSLY SIGNED AND ACCEPTED THAT THE "GOODS WERE RECEIVED IN GOOD CONDITION" ON DELIVERY, THIS DOES NOT REMOVE THE CUSTOMERS STATUTORY RIGHTS IN RESPECT TO THE GOODS THAT WERE SUPPLIED FAULTY.

E: WHERE CUSTOMER HAS ORDERED GOODS BY TELEPHONE ORDER, A COPY OF THE ORDER AND CONTRACT TERMS WILL BE SENT TO THE CUSTOMER.

THE CUSTOMER HAS SEVEN DAYS TO NOTIFY MAYFAIR (UK) LTD IN WRITING OF ANY DISCREPANCIES IN THE GOODS SPECIFIED, COST AND ANY RELATED MATTER OF THE TERMS AND CONDITIONS OF THE SALE OR CONTRACT.

IF THE CUSTOMER NOTIFIES THE COMPANY (MAYFAIR (UK) LTD) OF ANY DISCREPANCIES THEY WILL EITHER BE RECTIFIED TO THE CUSTOMERS DESIRE OR BE GIVEN THE OPTION TO ACCEPT THE CONTRACT TERMS AS WRITTEN OR CANCEL THE CONTRACT.

F: CUSTOMER MUST TAKE RESPONSIBILTY TO MAKE SURE THAT THE FIREPLACE APERTURE AND CHIMNEY ARE SUITABLE. ANY GAS OR ELECTRIC SUPPLY REQUIRED IS SUITABLY PROVIDED WITHIN A METER OF THE CENTRE OF THE FIREPLACE TO ALLOW THE CONTRACT TO BE COMPLETED. IF NOT SURE, CUSTOMER MUST SEEK INDEPENDENT PROFESSIONAL ADVICE BEFORE THE WORK COMMENCES.

G: THE TOTAL CONTRACT VALUE IS TO SUPPLY THE GOODS LISTED TOGETHER WITH, IF APPLICABLE, TO INSTALL THE GOODS CONFIRMED IN THE SECTION INSTALLATION SERVICES OVERLEAF. THE CONTRACT VALUE FOR INSTALLED FIREPLACES UNLESS EXPLICITLY STATED IN THE INVOICE DOES NOT INCLUDE FOR MAKING GOOD SUCH AS PLASTERING, REDECORATING PROVIDING CONSTRUCTIONAL HEARTHS, REPLACING SKIRTING, DADO RAILS OR FLOOR BOARDS ETC. IF CUSTOMER REQUEST THE COMPANY TO UNDERTAKE ANY ADDITIONAL WORK OF THIS NATURE, IF THE COMPANY AGREES, A QUOTE WILL BE GIVEN WHICH IF ACCEPTED MUST BE PAID IN FULL BEFORE THE WORK COMMENCES.

H: WE AS A COMPANY DO NOT CARRY OUT ANY PRE-INSTALLATION SURVEY SERVICE, THE CUSTOMER WILL BE SENT A PRE-INSTALLATION CHECK FORM TO FILL IN, IF IT IS FOUND ON THE DAY OF INSTALLATION THAT THE CUSTOMER HAS NOT CARRIED OUT ALL APPLICABLE ITEMS ON THE PRE-INSTALLATION FORM, IT MAY CAUSE INSTALLATION TO BE ABORTED. CUSTOMER WILL THEN BE CHARGED AN ABORTIVE INSTALLATION FEE TO THE AMOUNT CONFIRMED IN THE PRE-INSTALLATION FORM. FURTHER MORE IF IT IS FOUND THAT ANY STRUCTURAL ALTERATION IS NECESSARY OR MODIFICATION TO THE CHIMNEY OR THE FUEL BEFORE THE INSTALLATION CAN COMMENCE THE FIREPLACE GOODS WIIL BE LEFT WITH THE CUSTOMER UNTILL HAS BEEN CONFIRMED IN WRITING BY THE CUSTOMER THAT THESE WORKS HAVE BEEN COMPLETED. THE COMPANY WILL THEN RESCHEDULE THE INSTALLATION TO COMPLETE THE CONTRACT.

I: IF FOR ANY REASON THE CUSTOMER DOES NOT AGREE TO PAY FOR ADDITIONAL WORK FOUND NECESSARY AT THE TIME OF INSTALLATION THE GOODS WILL BE LEFT WITH THE CUSTOMER WITH THE CONTRACT DEEMED AS SUPPLY ONLY.
THE COMPANY WILL THEN REFUND ANY INSTALLATION COST PAID LESS THE ABORTIVE CALL FEES UNTILL SUCH TIME AS THEIR CUSTOMER CONFIRM IN WRITING THAT THEY ARE IN A POSITION TO HAVE THE FIREPLACE PRODUCT INSTALLED. THE INSTALLATION WILL THEN BE RESCHEDULE AND THE INSTALLATION COST REINSTATED.

J: THE COMPANY OFFERS A 12-MONTH WARRANTY GAURANTEE ON ALL FIREPLACE PRODUCTS AND WORKMANSHIP. IN THE UNLIKELY EVENT THAT DURING THE WARRANTY PERIOD ANY DEFECTS THAT ARE ATTRIBUTABLE TO THE FAULTY PRODUCTS SUPPLIED OR WORKMANSHP ARE FOUND YOU SHOULD WRITE TO THE COMPANY CUSTOMER CARE DEPARTMENT STATING YOUR INVOICE NUMBER AND DATE OF INSTALLATION TOGETHER WITH CONFIRMING WHAT DEFECTS HAVE BEEN FOUND. YOU CAN ALSO ASK FOR THE COMPLAINT FORM TO BE SENT TO YOUR ADDRESS.

ON RECEIPT OF YOUR NOTIFICATION THE COMPANY MAY WISH TO INSPECT ANY DEFECTS BEFORE CONFIRMING THAT THEY WILL BE RECTIFIED OR REPLACES FREE OF CHARGE UNDER THE COMPANIES 12 MONTH WARRANTY.

THE COMPANY GAURANTEE DOES NOT REMOVE THE CUSTOMER STATUTORY RIGHTS IN RESPECT TO THE PRODUCT THAT HAVE BEEN SUPPLIED AND / OR INSTALLED FAULTY.

K: WHERE A FIREPLACE IS TO BE USED FOR SOLID FUEL THE CUSTOMER SHOULD USE SMALL AMOUNTS OF SOLID FUEL FOR THE INITIAL FIVE OR SIX WEEKS TO ENABLE THE FIREPLACE COMPONENTS TO ADJUST TO THEIR NORMAL THERMAL EXPANSION AND CONTRACTION. THE COMPANY WILL NOT ACCEPT THE RESPONSIBILITY FOR FIREPLACE COMPONENTS WHICH CRACK DUE TO EXCESSIVE INTENSE HEAT ON FIREBACKS, REFACTORY BRICKS, HEARTHS, MARBLE, STONES, SLATE OR GRANITE AFTER THEY HAVE BEEN SUPPLIED. TTHIS DOES NOT REMOVE THE CUSTOMERS STATUTORY RIGHTS IN RESPECT TO THE PRODUCTS THAT HAVE BEEN SUPPLIED AND / OR INSTALLED FAULTY.

L: METALWARE AND CAST IRON USED FOR FIREPLACE COMPONENTS ARE SUPPLIED UNLAQURED DUE TO THEIR EXPOSER TO THE HEAT. THEREFORE IT IS THE CUSTOMERS RESPONSIBILITY TO MAINTAIN BRASS, STAILESS STEEL OR CAST IRON, WHICH WILL DISCOLOUR IF NOT POLISH OR OILED AT REGULAR INTERVALS AFTER INSTALLTION.

M: IN THE DEVELOPMENT OF A QUARRY, INEVITABLE VARIATIONS WILL OCCUR IN THE QUARRIED MATERIAL COLOUR SHADE AND VEINING. THEREFORE THE SAMPLE SHOWN OR DEPICTED WILL BE REPRESENTATIVE ONLY AND MAY NOT EXACTLY MATCH THE MATERIAL SUPPLIED, HOWEVER WE GUARANTEE THAT THE MATERIAL SUPPLIED WILL BE TO THE TRADE NAME SPECIFIED ON THE CONTRACT OR FROM THE PARTICULAR QUARRY NAMED.

N: ALL NATURAL STONES SUCH AS MARBLE, GRANITE AND SLATE CANNOT BE GUARANTEED FOR UNIFORMITY OR APPEARANCE, TEXTURE AND WITHOUT NATURAL VEINING FLAWS. SUBSEQUENTLY ALL MATERIAL ARE SOLD SUBJECT TO THE NATURAL DEFECTS WHICH IF NECESSARY WILL BE REPAIRED TO AN APPROVED STONE INDUSTRY STANDARD BEFORE DELIVERY OR INSTALLATION. THIS DOES NOT REMOVE THE CUSTOMERS STATUTORY RIGHTS IN RESPECT TO THE PRODUCTS THAT HAVE BEEN SUPPLIED AND / OR INSTALLED FAULTY.

A DELIVERY CHARGE IS PAID FOR THE GOODS REQUIRED DELIVERY, THE CHARGE WILL VARY DEPENDING ON DESTINATION AND THE COMLEXITY OF THE DELIVERY, MINIMUM CHARGE FOR THE DELIVERY IS £99.00. A £10.00 CHARGE WILL BE ADDED TO YOUR TOTAL FOR THE PACKING MATERIAL TO MAKE SURE YOUR ORDER HAS BEEN DELIVERED PERFECTLY.

O: EXISTING CHIMNEYS AND FLUE CAN HAVE A DEFECTS THAT WILL CAUSE FIRES TO SMOKE AND FOR SOME FUMES TO ENTER THE ROOMS. THE INTALLATION OF A NEW FIREPLACE TO AN EXISTING CHIMNEY OR FLUE IS COSMETIC ONLY. A NEW FIREPLACE IS NO GAURANTEE THAT SUCH EXISTING PROBLEMS WILL BE OVERCOME.

FURTHER MORE IT IS THE CUSTOMERS RESPONSIBILTY TO HAVE THE CHIMNEY OR FLUE SWEPT AND INSPECTED FOR OPERATING EFECIENCY TOGETHER WITH ENSURING THAT ROOMS MEET ANY CURRENT VENTILATION REQUIREMENTS FOR REAL OR GAS FIRES BEFORE THE INSTALLATION OF THE NEW FIREPLACE.

16. OPTION DEPOSIT CONTRACT

WHERE A CUSTOMER CANNOT IMMEDIIATELY PPROCEEED WITH THEIR ORDER WE WILL ACCEPT AN "OPTION CONTRACT" AT THE OFFER PRICE SECURED FOR CONTRACT PERIOD UP TO SIX MONTHS. DURING THAT PERIOD THE CUSTOMER CAN CONFIRM IN WRITING THAT THEY WISH TO PROCEED AT THE OFFER PRICE ENCLOSING THE BALANCE OUTSTANDING TO ENABLE THE GOODS TO BE SUPPLIED. IF AT ANY TIME DURING THIS PERIOD THE CUSTOMER CONFIRMS IN WRITING THAT THEY DO NOT WISH TO PROCEED WITH THEIR OPTION CONTRACT THEIR HOLDINGS DEPOSIT WILL BE REFUNDED IN FULL. AT THE EXPIRY OF THE SIX MONTH OPTION CONTRACT PERIOD THE CUSTOMER WILL BE ASKED WHETHER THEY WISH TO RENEW THEIR OPTION FOR A FURTHER SIX MONTHS AT THE CURRENT PRICE THEN APPLICABLE. IF NOT ANY DEPOSIT PAID WILL BE REFUNDED IN FULL.

P: WHERE THE CUSTOMER HAS APPLIED FOR A FIREPLACE LOAN, ANY DELIVERY OR INSTALLTION TIME INDICATED WILL ONLY BE APPLIED FROM THE DATE THAT THE CUSTOMERS LOAN HAS BEEN APPROVED.

Q: PAYMENTS FOR ALL FIREPLACE GOODS MUST BE PAID IN FULL BEFORE THEY ARE DISPATCHED.

FOR INSTALLED CONTRACT THE INSTALLATION COST MUST BE PAID ON COMPLETION OF THE INSTALLTION. WHERE THE COMPANY HOLDS THE CUSTOMERS CREDIT CARD DETAILS AND AUTHORISATION ON FILE ANY OUSTANDING BALANCE WILL AUTOMATICALLY BE TAKEN AGAINST THE CARDS DETAILS HELD UNLESS THE CUSTOMER CHOOSES TO PAY BY CASH OR CHEQUE.

R: IT IS ACCEPTED AND AGREED THAT THE CUSTOMER CAN NOT VARY OR AMEND HIS/HER CONRACT WITHOUT MAKING AN APPLICATION IN WRITING WITHIN SEVEN DAYS OF BEING GIVEN A TRUE COPY OF HIS/HER CONTRACT. IF THE COMPANY AGREES TO THE AMENDMENT OR VARIATION REQUESTED, IT WILL BE NOTED ON THE CONTRACT AND SIGNED BY A DIRECTOR OF THE COMPANY. A COPY OF THIS VARIED OR AMENDED CONTRACT WILL THEN BE SENT TO THE CUSTOMER IN CONFIRMATION. IF THE COMPANY DOES NOT ACCEPT TO AMEND OR VARY THE CONTRACT AS REQUESTED BY THE CUSTOMER IN WRITING, THE CUSTOMER WILL HAVE THE OPTION TO EITHER PROCEED OR CANCEL THE CONTRACT.

S: THE POLICY OF MAYFAIR (UK) LTD IS ONE OF CONTINUING IMPROVEMENT. THE COMPANY RESERVE THE RIGHT TO CHANGE THE SPECIFICATION OF THE PRODUCT DUE TO UNPREDICTABLE VARIATIONS IN THE PRODUCTION PROCESS OR TO COMPLY WITH CHANGES IN SAFETY REGULATIONS. THE CUSTOMER WILL BE NOTIFIED OF ANY CHANGE WHICH SIGNIFICANTLY AFFECTS THE QUALITY, APPEARANCE AND USEFULNESS OF THE PRODUCT FOR APPROVAL. THE CUSTOMER THEN HAS SEVEN DAYS TO NOTIFY THE COMPANY IN WRITING THAT THEY ACCEPT CHANGES NOTIFY OR CONFIRM THAT THEY WISH TO CANCEL THE CONTRACT.

T: NOTHING IN THESE TERMS AND CONDITIONS WILL REDUCE THE CUSTOMERS RIGHT RELATING TO FAULTY AND MISDESCRIBED GOODS OR SERVICES PROVIDED. IF YOU HAVE ANY DOUBTS ABOUT YOUR STATUTORY RIGHTS PLEASE CONTACT YOUR LOCAL TRADING STANDARDS DEPARTMENT OR CITIZEN ADVICE BUREAU.

THE COPY OF THIS TERMS AND CONDITIONS HAS BEEN GIVEN TO THE OFFICE OF THE FAIR TRADING.
